ModeratorWould you require a permit for a playhouse 6′ x 6′ with the lower level enclosed and the upper level a deck surrounded by a properly constructed guard that is accessed by a ladder? I suppose some could have issue with the ladder requirements. It would have the normally associated swing set attached to it along the side. Section 108.2 (2) would seem to require it. VCC Section 102.3 exemption (4) may seem to allow it. I suppose you could also use Section 108.2 (13). Office policy?

I have a similar situation, a 8×8 two story play house, both levels enclosed with interior stairs, lower level is 5 feet in height, upper level is 8 feet height. (Due to Zoning regulations that accessory structures cannot exceed 16′ in height)</span></p>

ModeratorI doubt I would require a permit for a play house. You could use:
102.3 Exemptions. The following are exempt from this code:
7. Nonmechanized playground or recreational equipment
such as swing sets, sliding boards, climbing
bars, jungle gyms, skateboard ramps, and similar
equipment where no admission fee is charged for its
use or for admittance to areas where the equipment is
located.
I would surmise the intent of the code is to not require a permit for this type of structure. However, if the owner requested a permit, I would issue one.

ParticipantThere are a few pieces of missing information, but this is my 2 cents worth. As described by definition this is a single story. The deck is a second level. A constructed playhouse would be an accessory structure in accordance with the IRC. Then the 108.2 exception would not require a permit, but compliance with the code, such as R302.1 exception 3, R403.1 exception 1.
102.3 is a copy of the Amusement Device Regulation section 13VAC5-31-30, “a device or structure open to the public” that is exempt from the code.
