If a 10’x10′ deck is built in the middle of the yard,close to the ground,would a permit be required?I know it is not an accessory structure like a tool shed,but well under the 256 sq ft limitation.I can understand if it is next to the house,but how about in the middle of the yard.
There is no specific exemption in the USBC for decks, therefore I would strongly suggest that you ask the building official of the jurisdiction for an interpretation. However, I believe you can apply the accessory structure permit exemption provided that the exception under 403 for footings is met which would also mean the guardrail height trigger has not been exceeded AND the structure does not carry a structural load like a hot tub. Prince William exempts no load bearing decks that are 16.5 inches or below to grade from requiring permits. The technical provisions of the code still apply, they just don’t need to be verified/confirmed by a permit and inspections.

Sean why 16.5″; for two risers of 8.25″ (+ 3/8 tolerance) if provided?
In accordance with 403 we allow 18″
8.25″ is your maximum allowable riser height according to Section R311.7.5 of the 2012 Virginia Residential Code. You have a maximum of 3/8″ variance between your tallest and shortest rises in that run of steps. I do not see where the code allows you to exceed the 8.25″ maximum riser height.
mjeutsey, I understand your explanation, however my question is in reference to 108.2 does your jurisdiction exempt deck permits and if so what’s the reason for the height limit?
