My builder didn’t follow the city provided approved plans but downsized the floor trusses. He also left out bolts in the foundation within 1 foot of corners as well as tie down straps usually installed when the concerete foundation is poured. His framers installed a bowed truss, widened the 19 inch span to 26 where the ductwork ran and field cut under the whirlpool tub. The home has sagging floors in less than a year. This shows up at doors, drywall, base trim, floors and vanities. He hired an engineer after I sent a formal complaint to say the trusses he used were adequate. …Now I pursue a remedy with the city building department.
But if it meets the minimum standards it really not a violation. It may be a contract issue but not a code issue. This is a tough one for the code department when they have a compliant project but not as presented for plan review. Really tough if it goes to court. Kind of like a catch 22 scenario.
It is definitely a breach of contract but if the City doesn’t catch the builder is installing TJI 210s instead of IB400s and that is stamped are allover the joists, why does he submit them to have the city reviewer stamp them as approved? 2 other builders have met with me and the city and stated the violations overlooked are Building 101. Missing tiie down straps per code on sill plate….so much more…. Now high shrink swell soil has been found and my home is built on uncompacted fill dirt- I hired a soil scientist….it is unbelievable…..
When you say ( City Provided Approved Plans ) does this mean that you provided engineered plans to the city and they approved them and then the contractor didn’t install the proper size TJI that was put on plans.
