We occasionally come across this in older homes in town where the owner wants to keep the original look of the front porch with the 30″ guardrail and non-compliant baluster spacing. This code section is more concerned with structural integrity of the deck/porch including the rails and guards than the secondary concern of falling/climbing over or through.
